Sodomy II: Anwar ordered to enter defence

KUALA LUMPUR: The High Court today ordered Opposition Leader Anwar Ibrahim to enter his defence on the charge of sodomising his former aide, Mohd Saiful Bukhari Azlan.“The prosecution has established the ingredients for a prima facie case,” Justice Mohamad Zabidin Mohd Diah told a packed courtroom.
The court has fixed June 6 to 30 to hear Anwar’s defence.
The court also ruled that Saiful was a credible witness since his testimony was corroborated by expert witnesses that there was penetration and that Saiful had been present at the condominium where the alleged act took place.
Anwar’s supporters, some coming from as far as Penang, had arrived at the Jalan Duta court complex here as early as 4.30 am.
The supporters performed prayers at the nearby mosque to seek divine intervention while the police beefed up security in the area.
Anwar, 64, was charged under Section 377B of the Penal Code with sodomising Saiful, 25, at the Desa Damansara condominium here on June 26, 2008.
If found guilty, the opposition leader could face a jail term of not less than five years and a maximum of 20 years.
Anwar had consistently denied the charge, saying that similar to the first sodomy accusation he faced in 1999, this too was a political conspiracy.
The trial, which started on Feb 3 last year, saw the prosecution calling a total of 27 witnesses.
The prosecution’s case relied heavily on the findings of two chemists, who established that the “Male Y” DNA profile found in Saiful’s anus belonged to Anwar.
On the defence case, Mohamad Zabidin concluded that Saiful was a reliable and credible witness despite the protestations of Anwar’s lawyer Karpal Singh.
Meanwhile, Anwar told reporters that he was not surprised by the ruling, adding that it seemed as though the judge had already “made up his mind”.
“It’s not just prima facie – it’s more like a conviction. The judge was pre-judging, and accepted the prosecution’s case as fact.”
Calling the trial and sodomy charges a “major conspiracy”, Anwar has sworn that the defence will interrogate all relevant witnesses, including Prime Minister Najib Tun Razak, his wife Rosmah Mansor, and former Inspector-General of Police Musa Hassan.
About 1,000 supporters, who thronged the court complex, shouted slogans and waved banners as Anwar left the courtroom.
Meanwhile, Saiful tweeted that he was pleased with the ruling, and prayed that the next phase of the trial would go on smoothly
